Louisiana Agricultural Chemistry and Seed Commission

Administers and enforces the laws and regulations relative to feed, fertilizer, agricultural liming materials, industrial hemp and seed

The Agricultural Chemistry and Seed Commission (‘Commission’) was created within the Department of Agriculture and Forestry by Act 26 of the 2013 Louisiana Regular Legislative Session. Its purpose is to administer and enforce the laws and regulations and to employ personnel necessary to implement the provisions of the Feed (La. R.S. 3:1391 et seq.), Fertilizer (La. R.S. 3:1411 et seq.), Agricultural Liming Materials (La. R.S. 3:1430.1 et seq.), Industrial Hemp (La. R.S. 3:1461 et seq.) and Seed (La. R.S. 3:1431 et seq.) laws and pursuant regulations.  

The Commission is given the authority to administer and enforce rules and regulations as are necessary to carry out the intent and purpose of the feed, fertilizer, agricultural lime, industrial hemp and seed programs.

Membership

The Commission consists of nine members, each representing a specific professional agricultural related entity:

  1. The Commissioner of agriculture and forestry (‘Commissioner’) or his designee.

  2. One member and an alternate, representing the Louisiana Agricultural Experiment Station, appointed by the Commissioner and who shall serve at the pleasure of the Commissioner.

  3. One member and an alternate, representing the Louisiana Cooperative Extension Service, appointed by the Commissioner and who shall serve at the pleasure of the Commissioner.

  4. The president of Louisiana Farm Bureau Federation, Inc. or his designee, subject to the approval of the Commissioner.

  5. One member representing the seed industry appointed by the Commissioner from a list of three nominees submitted by the Louisiana Ag Industries Association who shall serve at the pleasure of the Commissioner.

  6. One member representing the fertilizer industry appointed by the Commissioner from a list of three nominees submitted by the Louisiana Ag Industries Association who shall serve at the pleasure of the Commissioner.

  7. One member representing the feed industry appointed by the Commissioner from a list of three nominees submitted by the Louisiana Ag Industries Association and a list of three nominees submitted by the Louisiana Cattlemen’s Association who shall serve at the pleasure of the Commissioner.

  8. One member actively engaged in farming appointed by the chairman of the House Agriculture, Forestry, Aquaculture, and Rural Development Committee.

  9. One member actively engaged in farming appointed by the chairman of the Senate Agriculture, Forestry, Aquaculture, and Rural Development Committee.

The Commissioner shall serve as the ex officio chairman of the Commission and shall be its chief executive officer responsible for enforcement. Additionally, the Commissioner is empowered to employ personnel, to purchase supplies, and to make such other expenditures as may be necessary for enforcement of the programs.

The Commission may appoint a director and assistant director of the feed, fertilizer, agricultural lime, and seed programs, each subject to the approval of the Commissioner. The directors and assistant directors shall be in the unclassified service. All employees of the Commission shall be under the supervision and direction of the Commissioner.
